Intermarkets Kept Out of Middle East Food Contract Protest

Intermarkets Alliance and USFI Inc., Joint Venture can’t intervene to support the Defense Logistics Agency in ANHAM FZCO’s protest challenging the agency’s decision to reopen a Middle East food supply procurement, the U.S. Court of Federal Claims said.

Intermarkets, which said it planned to submit a bid in a reopened competition, didn’t show that its position materially differs from that of the agency, Judge Patricia E. Campbell-Smith said Thursday.

Existing parties adequately represent Intermarkets’s interest in the case, the court said.

The court also said that Intermarkets can’t properly reassert grounds for its previous protest of a food contract award,...
