Oregon ski resort operators waited too long to bring their suit alleging that the US Forest Service breached their special use permit contract by allowing “dangerous” snowmobile related activity in the ski area parking lot and by revoking the permit when the operators closed their resort.
The US Court of Federal Claims issued a judgment on Wednesday granting the government’s motion to dismiss.
The court on June 5 issued an opinion stating that the complaint filed by John and Nancy Murray was untimely under a six-year statute of limitations.
