D.C. Metro Shielded From Schindler’s Escalator Contract Protest

Schindler Elevator Corp. failed to convince an appeals court that it can protest the Washington Metropolitan Area Transit Authority’s decision not to award it a contract to replace escalators throughout Metro Rail System stations.

WMATA, which is an interstate compact entity, didn’t waive sovereign immunity and allow the challenge to its procurement decision, Karen LeCraft Henderson of the U.S. Court of Appeals for the D.C. Circuit said in a Friday opinion.

Maryland, Virginia, and the District of Columbia have waived WMATA’s sovereign immunity in only a “narrow set of circumstances” that don’t include challenges to procurement decisions, the court said. ...
