Alabama Nonprofit Beats False Claims Act Retaliation Appeal

Two former employees failed to show that nonprofit Spirit of Athens Alabama Inc. violated the False Claims Act by firing them in retaliation for raising concerns about the organization’s alleged misuse of federal funds, the Eleventh Circuit affirmed.

Dana Hickman and Robin N. Hines contended they lost their jobs when they were on the verge of revealing misuse of funds from the Tennessee Valley Authority, but they didn’t show a reasonable belief that the organization made a false claim to the government, the U.S. Court of Appeals for the Eleventh Circuit said Tuesday.
