Wind Farm Owners Lose Appeal to Recoup Clean Energy Grants

Two wind farm owners failed to show that a development fee they included in federal grant applications wasn’t a “sham,” and they therefore owe the federal government for overpayment, the Federal Circuit affirmed Thursday.

California Ridge Wind Energy LLC and Bishop Hill Energy LLC applied for grants based on their project’s costs under a now-expired program known as Section 1603. The Treasury Department awarded California Ridge about $9 million less than the amount it sought, and it awarded Bishop Hill about $12 million less.
