Wildlife Agency Must Face Lawsuit Over Arizona Grazing Damage

The U.S. Fish and Wildlife Service is required to take a new look at whether an agency action may harm a protected species or its habitat, a federal court in Arizona ruled.

The agency sought to avoid a lawsuit over its alleged failure to re-initiate consultation under the Endangered Species Act after unauthorized livestock grazing damaged public lands in Arizona. Contrary to the federal government’s argument, the U.S. Forest Service isn’t the sole agency responsible to re-initiating consultation, according to the U.S. District Court for the District of Arizona.
