West Virginia Approval of Union Carbide Site Cleanup Upheld

West Virginia’s acceptance of Union Carbide Corp.'s application to enter its site into the state’s voluntary contamination cleanup program will stand after a federal judge ruled an attempt to block the application was “neither necessary nor appropriate.”

Courtland Co. urged the U.S. District Court for the Southern District of West Virginia to direct Union Carbide to withdraw its “improper and illegal application.” Courtland also sought an order blocking the state Department of Environmental Protection from issuing an order concerning the Filmont Landfill and Massey Railyard.
