Washington’s Clean Water Lawsuit is Too Late, Mine Owner Says

Water pollution claims from the state of Washington and a conservation organization against the owners of a mine are based on alleged violations that happened in the past and should be dismissed, the mine owners say in a motion filed in a Washington federal court.

Kinross Gold U.S.A. Inc. and its subsidiary Crown Resources Corp. are accused of violating the conditions of a National Pollutant Discharge Elimination System (NPDES) permit issued under the Clean Water Act for the Buckhorn Mountain Mine. The companies are also accused of violating the state Water Pollution Control Act.
