Suits against Volkswagen and related companies by Florida and Utah counties alleging the companies used software updates to cheat on diesel vehicles’ emissions tests will proceed without additional review from the Ninth Circuit.
VW intends to seek review by the U.S. Supreme Court, the company said in an emailed statement.
