Utah Gold King Mine Cleanup Claims Advance Against Subcontractor

Utah’s environmental damages claims against a mining subcontractor that worked at Colorado’s Gold King Mine before a massive 2015 spill survived a dismissal bid as a federal district court in New Mexico found sufficient jurisdiction over the company.

Harrison Western Construction Corp. is a mining services subcontractor that Environmental Restoration LLC retained a year before the blowout to help reopen the mine. The U.S. District Court for the District of New Mexico said Utah had submitted facts about the subcontractor that, if true, would support jurisdiction, and denied Harrison Western’s motion to dismiss in an opinion issued Tuesday.
