Utah County Avoids Ranch Developer’s Superfund Liability Claims

A Utah county avoided liability under Superfund law for a former family-owned ranch where development was allegedly thwarted by the possibility of contamination, according to an order from the District of Utah.

Resort Center Associates LLC alleged the Environmental Protection Agency and Summit County unconstitutionally took its property by including it in the Richardson Flat Tailings proposed Superfund site, despite a contractor’s report that future residents wouldn’t be exposed to hazardous substances.
