Union Pacific Must Report Flammable Liquids, Other Data

Union Pacific Railroad Co. lacked evidence supporting its argument that sharing with states certain county-level information, and data about its transportation of flammable liquids, failed to protect confidential business information in violation of federal law, according to the D.C. Circuit.

Union Pacific provided “not a mote of evidence” that the information at issue in its petition for review, which is used for spill-response efforts, has been or could be exploited, the U.S. Court of Appeals for the D.C. Circuit said in its ruling issued Tuesday.
