Union Pacific Denied Bid to Stop Chemical Leak Suit in Texas

Union Pacific Railroad Co. lost a bid on Friday to have the Texas Supreme Court review a decision that forces the company to face a lawsuit over its alleged failure to warn Houston-area residents of cancer causing contaminants in the soil and groundwater.

Betty Chenier of Kashmere Gardens, a historically Black neighborhood, and a dozen other residents sued the rail giant alleging negligence, fraud, and nuisance after it allegedly released creosote, a toxic chemical used to treat wooden railroad ties, into the environment.

The residents, who allegedly suffered property damages and personal injuries, seek over $50 million in damages.
