Unclear if Lawsuit Over EPA’s First Chemical Evaluation Is Ripe

A statement the EPA made in its final methylene chloride risk evaluation suggests that environmental and labor groups can challenge the agency’s conclusion that some of the solvent’s risks are acceptable, some attorneys said Friday.

Yet the lawsuit may not be as “ripe” for court review as it appears at first, other attorneys said.

Neighbors For Environmental Justice, the New Jersey Work Environment Council, the Sierra Club, the United Steelworkers Union, and the Natural Resources Defense Council asked the U.S. Court of Appeals for the Ninth Circuit on Thursday to review the EPA’s final risk evaluation for methylene chloride.
