U.S. Pushed to Unwind Trump Rule on Environmental Settlements

Conservation groups are calling on the Justice Department to eliminate Trump-era restrictions on a popular settlement tool used in environmental cases.

The Conservation Law Foundation, Surfrider Foundation, and Sierra Club on Monday submitted a petition for the department to clarify its policy on supplemental environmental projects, or SEPs, and scrap a related rule issued by Trump appointees late last year.

“Without clear rules, the reasoning behind DOJ’s settlement practices will only become more difficult for the public to understand and will continue to be subject to frequent change,” Democracy Forward Foundation lawyers wrote on behalf of the environmental groups.
