Sunoco’s Mariner East 2 Pipeline Didn’t Need Stormwater Permits

Sunoco Pipeline LP didn’t violate federal law by not seeking stormwater permits for its Mariner East 2 Pipeline Project despite a conservation group’s argument that they were required under the Clean Water Act, the Eastern District of Pennsylvania ruled.

Holding Sunoco liable for failing to get National Pollutant Discharge Elimination System permits after the Pennsylvania Department of Environmental Protection determined the pipeline was exempt would “offend the basic principles of fairness” and “effect an absurd result,” the U.S. District Court for the Eastern District of Pennsylvania ruled Thursday.
