Stalled New York Shale Pipe Gets Second Chance With Court Case

A stalled shale gas pipeline may get another shot at moving ahead after the top U.S. energy regulator told a federal appeals court that it wants to take another look at the project.

At issue is whether New York waited too long to deny a key water permit for Williams Cos.’ Constitution pipe, giving the Federal Energy Regulatory Commission the authority to review the decision. Earlier this year, a court ruled that FERC could do just that in a case involving a series of hydroelectric dams on the California-Oregon border.
