Sherwin-Williams Loses Challenge to Threatened Lead Paint Suit

Sherwin-Williams can’t proceed with a suit alleging that “threatened,” future lead paint abatement suits by Delaware County, Pa., would violate the company’s constitutional rights, a federal court in Pennsylvania ruled.

The potential filing of a suit by the county isn’t a concrete injury that would allow it to proceed with a declaratory judgment action, the U.S. District Court for the Eastern District of Pennsylvania said Oct. 4.

Sherwin-Williams alleged that Delaware County is in the process of retaining counsel in bring suit against the company to pay for the inspection and abatement of lead paint.
