Rio Bravo Denied Rehearing Over Mandated FERC Climate Review

Rio Bravo Pipeline Co. LLC failed to convince the D.C. Circuit to reconsider its decision that FERC must complete a more extensive climate review of liquefied natural gas projects in Texas.

The Federal Energy Regulatory Commission approved projects by Texas LNG Brownsville LLC, Rio Grande LNG LLC, Annova LNG Common Infrastructure LLC, and Rio Bravo Pipeline Co. in 2019. The agency, however, failed to review the projects’ impacts using research “generally accepted by the scientific community,” according to the U.S. Court of Appeals for the D.C. Circuit.
