Revoked Coal Leasing Order Moots Lawsuit, Mining Group Says

A lawsuit filed over the Trump administration’s order lifting a moratorium on federal coal leasing should be dismissed because the Biden administration revoked that order, a mining group told a Montana federal court.

All of the conservation groups’ and the Northern Cheyenne Tribe’s claims are now moot, the National Mining Association says in its filing in the U.S. District Court for the District of Montana.

The groups’ effort to continue shows an “impermissible attempt” to expand the scope of their complaints and have the court “judicially legislate federal coal leasing policy,” the mining group told the court Tuesday.
