Power Line Funding Rule Must Go Back to FERC, D.C. Circuit Says

The Federal Energy Regulatory Commission will have to take another stab at explaining its decision to give transmission owners unilateral authority to fund power line upgrades in the Midwest after the D.C. Circuit ruled the agency didn’t adequately explain its decision.

When power generators build new facilities, transmission owners often have to upgrade their power lines to accommodate the power influx—and generators pay for almost the whole cost of those upgrades. In 2018, FERC decided that all transmission owners in the Midcontinent Independent System Operator (MISO) region should have the unilateral authority to choose to fund upgrades.
