Poland Wins Court Clash With EU Over Tax on Retail Industry

Poland won a challenge against the European Commission over a 2017 decision that classified a tax on the retail sector in the country as illegal state aid.

  • The EU General Court said in ruling May 16 that the commission “incorrectly classified” the tax as state aid and annuls decision.
  • “The commission was not entitled to infer solely from the progressive structure of the new tax on the retail sector that that tax entailed selective advantages,” the court said, adding that the EU regulator also “failed to establish in the contested decisions the existence of a selective advantage.”
