‘Outdated’ Washington Water Quality Rules Must Get New EPA Look

The U.S. Environmental Protection Agency saw its deference to Washington state rejected when a federal judge handed a conservation group a win and said the agency must decide whether the state needs to update its water quality standards for the first time in nearly three decades.

The Clean Water Act’s cooperative federalism framework doesn’t justify the agency’s refusal to make a finding when evidence shows the state “had essentially abandoned its duties,” according to the U.S. District Court for the Western District of Washington.
