Oregon Ranchers Lose Challenge to Klamath Water Rights Agreement

Oregon ranchers failed to show their irrigation rights were being harmed by the federal government’s water rights agreement with Klamath Tribes, the D.C. Circuit affirmed Friday.

The 2013 Protocol Agreement doesn’t delegate authority to the tribes but instead recognizes the tribes’ existing authority to control their water rights, according to the U.S. Court of Appeals for the District of Columbia Circuit. Therefore, the ranchers failed to show causation or the kind of injury that can be redressed and is needed to establish standing, the court ruled.
