Ohio to Defend EPA’s Nixing of State Air Pollution Nuisance Rule

Ohio can intervene in a lawsuit to support the EPA’s decision to remove a pollution rule from its air quality implementation plan, but business associations also in support will have to sit on the sidelines, the Sixth Circuit ruled.

Environmental groups and individuals are challenging the agency’s removal of Ohio’s air pollution nuisance rule from the state implementation plan. The rule banned emissions of smoke, dust, gas, and other substances that may threaten public health or damage property.
