New York Fracking Ban’s Persistent Legal Foe Loses Again

The New York landowner behind repeated challenges to the Empire State’s fracking ban lost yet again Tuesday when federal judges rebuffed his latest legal volley.

The U.S. Court of Appeals for the Second Circuit tossed David R. Morabito’s case, halting the landowner’s bid to overturn hydraulic fracturing restrictions in place since 2014.

“I have to analyze the decision from the United States Court of Appeals for the Second Circuit to make a determination of what course of action, if any, I can take,” Morabito, who is an attorney and represented himself in the case, said Tuesday.
