New Mexico’s Gold King Mine Claims Survive Federal Objection

New Mexico’s claims for millions of dollars in economic damages caused by the Gold King Mine blowout withstood a challenge from the Justice Department when a federal district court held that the state was a proper plaintiff.

The federal government sought to dismiss claims for economic damages New Mexico filed on behalf of its environmental agency, because the agency itself failed to allege any tort claims, doesn’t collect taxes, and doesn’t own any rivers affected by the Gold King Mine blowout, according to the U.S. District Court for the District of New Mexico.
