First Lawsuit Challenging EPA’s Chemical Test Order Filed

A coalition of companies making a solvent that the EPA is examining for possible regulation has asked a federal court to overturn an agency order seeking data to understand whether the chemical could harm wildlife.

The Vinyl Institute, which manages the group of seven companies, filed the first legal challenge to the Environmental Protection Agency’s use of a new test order authority Congress gave it through the 2016 Toxic Substances Control Act (TSCA) amendments. A coalition of community groups previously sued the agency for failing to use that authority.
