Navajo Nation Suit Takes Aim at Trump Administration Waters Rule

The Trump administration’s narrowly defined protections for the nation’s water bodies and wetlands is facing yet another legal challenge since the rule took effect, this time from the Navajo Nation.

A complaint filed Monday in the U.S. District Court for the District of New Mexico seeks to vacate the Navigable Waters Protection Rule, which replaced the Obama administration’s definition of waters and wetlands that fall under the federally protected waters of the U.S., or WOTUS.

The Navajo Nation’s lawsuit also seeks to overturn an earlier 2019 rule that rescinded the 2015 Clean Water Rule and re-adopted a 1986 definition.
