N.J. Township’s Development Ban Tied to Superfund Status Upheld

A New Jersey township was barred from redeveloping land during tax years 2004 through 2018 because of the area’s Superfund designation and listing on the National Priorities List, a state appeals court affirmed Wednesday.

The property’s known contamination, related public concerns, and conflicting expert testimony supported the state Tax Court’s finding that removing part of the area from the National Priorities List “was not available for the asking,” according to the New Jersey Superior Court, Appellate Division in an unpublished ruling.
