Mountain Valley Pipeline Permits Improper, Fourth Circuit Says

The Army Corps of Engineers’ West Virginia and Virginia districts likely violated the law by approving water permits for Mountain Valley Pipeline, the Fourth Circuit said Tuesday in an opinion related to a previous order blocking construction on the project.

The Corps’ Huntington, W.Va., district verified in September that the project met its qualifications under Nationwide Permit 12, which allowed the pipeline to skip the individual permitting process. That same day, the Corps’ Norfolk, Va., district reinstated its verification allowing the pipeline to use the permit in its district.
