Mountain Valley Pipeline Draws Another Environmental Challenge

A planned West Virginia-to-Virginia gas project drew a second challenge by environmental groups who say in a Fourth Circuit filing that the U.S. Fish and Wildlife Service arbitrarily found the Mountain Valley Pipeline wouldn’t have a significant impact on federally protected species.

The joint petition for review filed Tuesday in the U.S. Court of Appeals for the Fourth Circuit challenges the agency’s biological opinion and incidental take statement for species listed under the Endangered Species Act.
