Mosaic Discharge Permits OK Despite Radioactive Byproduct Risks

The U.S. Army Corps of Engineers has beaten a challenge at the Eleventh Circuit to four discharge permits issued to Mosaic Fertilizer LLC needed to expand its Florida ore mining operations. The court said Nov. 4 that potential adverse effects stemming from the storage of a radioactive byproduct fell beyond the scope of the agency’s action.

The Corps approved discharge permits under the Clean Water Act, not mining permits or production permits, for the expansion of Mosaic’s phosphate activities, Judge John M. Rogers said for a split panel of the U.S Court of Appeals for the Eleventh Circuit.
