Montana, Navajo-Owned Coal Firm Reach Deal on Sovereignty

Navajo Transitional Energy Company has agreed to a limited waiver of its tribal sovereign immunity in Montana, which will give the state the ability to enforce environmental regulations at the company’s Spring Creek Mine in Big Horn County, Mont.

The state said citizens’ groups also will be able to sue to enforce environmental and other violations of the law at Spring Creek, Rebecca Harbage, spokeswoman for the Montana Department of Environmental Quality, said Thursday.
