Mining Company Joins Supreme Court Fray on EPA Climate Rules

Coal company Westmoreland Mining Holdings LLC added the latest request to a stack of petitions asking the U.S. Supreme Court to weigh in on EPA’s authority to regulate greenhouse gases.

The Environmental Protection Agency can’t regulate carbon from coal-fired power plants under certain sections of the Clean Air Act when those existing sources are already regulated elsewhere in the Act, according to the petition filed last week and docketed Wednesday.

Nor does the Clean Air Act give the agency expansive power under the section to decide “whether and how to restructure the nation’s energy system,” according to the petition.
