Maui County Must Get Water Pollution Permit, Despite EPA Memo

The EPA’s guidance on how to apply a recent Supreme Court decision failed to sway a federal judge from mandating that Maui County, Hawaii, get a water pollution permit for its releases into injection wells at a facility near the ocean.

The Environmental Protection Agency said in its January guidance that a facility’s design and performance should be considered when deciding whether a release amounts to a direct discharge that triggers the need for a National Pollutant Discharge Elimination System permit.
