Land Agency Must Face Challenge to Fossil Fuel Development Plan

The Bureau of Land Management can’t avoid, or transfer to a different venue, some claims in a lawsuit over its alleged failure to study the environmental and health impacts of its fossil fuel development plans in Wyoming and Montana, a Montana federal court ruled Thursday.

The case doesn’t involve “real property” in Wyoming, contrary to the agency’s argument, the U.S. District Court for the District of Montana said. Also, “a substantial part of the events that gave rise” to the claims occurred in Montana, according to the ruling.
