Kinross Handed Win in Gold King Mine Jurisdictional Dispute

The federal government failed to show that a New Mexico federal court clearly has jurisdiction over Kinross Gold Corp. in their ongoing dispute over cleanup costs linked to the 2015 Gold King Mine spill, a judge ruled.

The U.S. District Court for the District of New Mexico ruled in May that Kinross isn’t subject to personal jurisdiction in the state. However, it allowed the government to file a motion under a federal rule that provides for such jurisdiction if a defendant isn’t subject to jurisdiction in another court.
