Kinder Morgan Shows Texas Anti-SLAPP Law Applies in Tax Trial

A Kinder Morgan Production Co. LLC appraisal dispute will proceed after a state appeals court agreed that the Texas anti-SLAPP law applies to tax matters.

The oil and gas pipeline company’s rights to petition and free speech are protected by the state’s anti-SLAPP law, the Texas Citizens Participation Act, in a dispute with Scurry County, Snyder Independent School District, and Scurry County Junior College, the Texas Court of Appeals, Eleventh District said.

The three entities—called taxing units by the court—sought to have mineral interests owned by Kinder Morgan in their jurisdiction reappraised for the tax years from 2013 to 2018. ...
