Kansas Counties Lose Bid for Rehearing in Prairie Chicken Suit

A group of Kansas county governments failed to convince the Tenth Circuit to reconsider its decision that they weren’t harmed by the government’s delay in sending a rule to Congress on evaluating conservation efforts when considering whether to grant endangered species protections.

The Kansas Natural Resource Coalition said it couldn’t rely on the rule when implementing its own conservation plan for the lesser prairie chicken without Congress’ approval under the Congressional Review Act.

The U.S. Court of Appeals for the Tenth Circuit disagreed, saying there’s no indication that local governments or property owners are refusing to participate in the plan. ...
