Kansas Counties Bring Prairie Chicken Dispute to High Court

A coalition of Kansas county governments can show it was harmed by the Department of Interior’s failure to send a rule to Congress that could affect the government’s decision to protect the lesser prairie chicken, according to a petition filed in the U.S. Supreme Court.

The petition centers on the policy for evaluation of conservation efforts when making listing decisions, also known as the PECE Rule. The rule sets criteria to use when considering whether conservation efforts “that have yet to be implemented or to show effectiveness” make listing a species as threatened or endangered unnecessary.
