Judge Denies Some of Duke Energy’s Claims in Coal Ash Waste Case

A North Carolina judge Aug. 2 dismissed a handful of claims Duke Energy brought against the state’s coal ash excavation order.

North Carolina ordered Duke Energy Progress LLC in April to excavate its coal ash and move it into landfills with protective liners, stating that is the only way to protect human health and the environment.

The company is appealing the order, but a state Office of Administrative Hearings judge dismissed its claims that the state’s Department of Environmental Quality couldn’t set a 2029 deadline, and couldn’t make closure decisions before the company submitted a closure plan.
