High Court Should Let VW Tampering Decision Stand, Counties Say

A Ninth Circuit decision allowing two counties to sue Volkswagen Group of America Inc. for emissions tampering through post-sale software updates doesn’t warrant review because VW evaded the very regulations it considers at odds with the state-law claims, the counties told the U.S. Supreme Court.

Hillsborough County, Fla., and Salt Lake County, Utah, aren’t seeking to penalize anything the Environmental Protection Agency approved, so there’s no conflict with federal law, the counties said in a brief Thursday.
