Herring Fishermen Lose Challenge to Industry-Funded Monitoring

The U.S. Department of Commerce acted within its authority when it issued a rule requiring an industry-funded monitoring program in the Atlantic herring fishery, a Washington federal court ruled Tuesday in a loss for a group of commercial fishing companies.

The Magnuson-Stevens Fishery Conservation and Management Act allows fishery management plans to require at-sea monitors and any “necessary and appropriate” conservation requirements, according to the U.S. District Court for the District of Columbia.
