GM Bankruptcy Trust’s Lake Onondaga Superfund Suit Premature

General Electric Co., Bristol-Meyers Squibb Co., Honeywell International Inc., and dozens of other companies shook off Superfund claims related to contamination of New York’s Onondaga Lake after the Northern District of New York found a bankruptcy trust established to manage General Motors’ environmental actions jumped the gun when it filed the suit.

The claims aren’t “prudentially ripe,” because the Environmental Protection Agency hasn’t decided on a course of action for the expanded territory that is the subject of the suit, the U.S. District Court for the Northern District of New York said.
