Florida’s Natural Beats Appeal in Orange Juice Glyphosate Suit

Citrus World Inc. and Florida’s Natural Growers Inc. beat an appeal in the Second Circuit, when the court affirmed dismissal Friday of a would-be class suit alleging “Florida’s Natural” brand orange juice was misleadingly marketed because it contained trace amounts of the synthetic weedkiller glyphosate.

Alexandra Axon alleged the residue made use of the term “natural” in the product’s brand name deceptive.

But the packaging doesn’t describe the orange juice as “natural” anywhere else, and a reasonable consumer wouldn’t be fooled by the brand name, the U.S. Court of Appeals for the Second Circuit said in a nonprecedential summary order. ...
