Fisheries Agency Appeals Order Vacating Dolphin Bycatch Rule

The Biden administration is challenging an order to vacate a rule that threatened to close a West Coast fishery if fishermen exceeded limits on whale, dolphin, and sea turtle bycatch, according to a filing in a Washington, D.C., federal court.

The National Marine Fisheries Service tried to withdraw the proposed Hard Caps Rule in 2017, saying it was inconsistent with National Standard 7 of the Magnuson-Stevens Fishery Conservation and Management Act. The standard requires environmental mitigation to “minimize costs and avoid unnecessary duplication.”
