The federal government can’t shake a lawsuit by real estate developers who say the U.S. Navy failed to properly supervise the cleanup of radioactive contamination in San Francisco, a California judge ruled.
The government argued the developers had to show the government’s actions didn’t involve an element of judgment. But it was the government’s responsibility to show its actions were discretionary, according to the U.S. District Court for the Northern District of California.
The government’s failure to do so means it isn’t entitled to immunity, the court said Wednesday.
