Feds Escape Some Environmental Claims in Immigration Policy Suit

The Biden administration must face claims that it ended border wall construction and the so-called “remain in Mexico” policies without required environmental review, a federal judge in Washington, D.C. ruled.

The plaintiffs aren’t challenging the “remain in Mexico” policies themselves, but instead the decision to proceed without review under the National Environmental Policy Act, according to the US District Court for the District of Columbia. This action isn’t within the agency’s discretion as the federal government argues, the court said.
