Federal Judges Question Power to Impose Deadline on EPA

Federal judges are asking whether a court could impose a deadline for EPA determinations for 2015 ozone pollution standards if the court grants a remand.

The judges asked for additional briefing on the deadline issue on Nov. 7, asking that petitioners’ briefs be submitted on Nov. 18 and respondents’ and respondent-intervenors’ briefs on Nov. 25.
